The second Trump declares a National Emergency, Dems should open up an investigation for impeachment proceedings on a clear abuse of power.

Spanky lost but has to try to make it look like a win to his supporters by declaring an “emergency”, which will stay tied up in the courts until we get a new POTUS. Is he tired of winning yet?

And the key point, McConnell says he supports a national emergency:

"He also will be issuing a national emergency declaration at the same time. I indicated to him I’m going to support the national emergency declaration.”

What happens next is (1) a lawsuit is filed immediately, (2) Pelosi puts up a resolution disapproving the national emergency under the National Emergency Act, it passes (and puts every republican on the spot on an issue where Trump’s fascist plan gets 24% approval), and then (3) the senate MUST vote on the resolution, which can’t be filibustered. It will get 51 votes, the question is now many? It very well might get to 60+. Again, every republican senator is put on the spot, (4) trump then has to veto that…

Which takes us back to the legal case… Once Congress has not only voted not to give Trump the funds, but then to undercut his emergency decleration, there is a major constitutional issue.

The actual National Emergency Act allowed congress to overturn the president’s action with a simple vote. That was found unconsitutional as undercutting the veto. But I think that the president in effect seizing congresses power, aided by a court ruling which changed the law, will be found in an “as applied” challenge to be an unconstitutional delegation of power. And even were it not, under the Youngstown Sheet Steel factors as laid out by Justice Jackson, Trump’s power is at it’s lowest ebb.

I think there is zero chance that the Court’s uphold what Trump does, and it will likely be rather stinging it its rebuke of him.

So another “set the republican party on fire” moment, for no gain, other than looking strong on FOX news and keeping the Ann Coulters and Stephen Millers of the world in a state of agitation.

Hoo boy, here we go. Stand by for Speaker Pelosi to call a vote to revoke the Emergency immediately after the declaration, followed by a forced Senate vote (which will fail, but no R’s want to be on record for this). And then years of court battles. Grab the pocorn everyone!

Don’t put it past the packed courts to decide that when a GOPer does it, the Constitution says it’s entirely within his discretion what constitutes an emergency, knowing full well that the Dems won’t abuse it anyway and that even if they try to, they can cook up some nonsense as to why it doesn’t apply in that particular situation.

It’s time now for every 2020 Presidential Dem candidate and potential candidate to say how they’re planning on using a National Emergency if it passes the courts and they’re elected President. Start with the apoplexy-inducing ones like gun control and climate change, and move on from there.

Not a bad play by Trump. His declaration of emergency will be immediately challenged and stall in court and ultimately be disallowed because “emergency”. However, Trump will be able to tell his base he did all he could.

Verbatim from NYT report by Peter Baker. There’s no evidence of support or enthusiasm.

Senator Mitch McConnell, the majority leader, announced on Thursday that President Trump planned to declare a national emergency so he can bypass Congress and build his long-promised wall along the southwestern border.

That raised the prospect of a constitutional clash with lawmakers over who controls the federal purse.

Mr. McConnell said the president would take action after signing a bill to keep the government open but not fund his wall.
