Is it unusual for someoneâs former attorney to be subpoenaed to a grand jury? Surely that person will claim atty-client privilege and will say nothing.
Yeah, I would assume thatâs going to be problematic. Getting around that privilege is one hell of a high hurdle. In effect, you have to demonstrate that the attorney is virtually a co-conspirator, a partner in crime. Law and Order notwithstanding, I have to think itâs a pretty rare occurrence IRL.
