Discussion: Man Charged With Assault For Sucker-Punching Black Protester At Trump Rally

John McGraw, 78, was charged Thursday with assault and battery and disorderly conduct after he allegedly punched a black protester at Donald Trump’s rally in Fayetteville, North Carolina, according to local TV station WNCN.

Sir, this is really no way to behave as you near the end of your ignorant, useless life.

In my day in the 35th Judicial District, someone with no priors would probably have got an offer of 1 year’s deferred adjudication probation. Serve it successfully and the charge is dropped. Fail and you can be sentenced for up to the (one year + fine) max.

Rand Paul: This is not really a big deal. My supporter stomped on the protestor’s head and got away with probation. Liberals/Blacks deserve it:

The sheriff, to his credit, is at least saying the right thing:

Cumberland County Sheriff Earl “Moose” Butler said in a statement,

No one should be subjected to such a cowardly, unprovoked act as that committed by McGraw. Regardless of political affiliation, speech, race, national origin, color, gender, bad reputation, prior acts, or political demonstration, no other citizen has the right to assault another person or to act in such a way as this defendant did. I hope that the courts will handle this matter with the appropriate severity for McGraw’s severe and gross violation of this victim’s rights.”

But whoever decided to tackle and handcuff victim of this unprovoked assault has some serious 'splaining to do.

Who and what can the black protester sue in this situation? Trump Campaign? The hired Security? The venue?

I presume he could at least sue the guy who hit him.

I was appalled that the WSJ article says Trump’s events are considered private and thus they can make the rules about who stays or goes.

If this is true, the Secret Service should withdraw their security forces from Trump rallies. This is especially true after the Secret Service attacked a Time photographer for daring to leave the press zone declared by the Trump security team. The Sec. Svc. has no business being an enforcer for Trump. Their presence alone is an endorsement of Trump’s violence towards protesters.

Secret Service protection for candidates for President is not contingent on the label an event is tagged with. Many people eligible for Secret Service protection participate in all manner of private events. Do you think if Obama and his wife sneak out for a private dinner or a visit with friends, where no public attendance is permitted, the Secret Service is prohibited from accompanying him?

The significant difference here is that the President does not hold private events where he advocates violence against nonviolent protesters.

I doubt the Secret Service is tasked with judging the merits or propriety of the speech of their protectees when decisions are made to accompany them wherever they travel or the events they attend or organize.

but the guy who was punched wasn’t simply handcuffed, was he? from the video, he was thrown to the ground, face down, held down and THEN handcuffed.

at least there is some level of investigation of the officers’ conduct, too

I’m guessing he’ll get a cabinet level position in the Trump White House. Normally it would be an ambassadorship, but I’m guessing Cletus here has no interest in stepping outside of the USA.

McGraw was charged with assault, but not arrested at the rally? The correction there wasn’t very “clarifying.”

Or won’t have to explain anything. This is not the first time the victim only of a violent assault at a Trump rally, was arrested. Chris Morris of TIME magazine was grabbed, choked, and body slammed onto a table and then the ground (by an agent of the United States Secret Service), then manhandled and thrown out by Trump security and police.

As much as I’d like to see him convicted, I’m more concerned about the police reaction. I hope those guys get more than a paid vacation for their gross misjudgment. Doc them pay or better yet turn them into parking attendants.
