DACA was enacted in June 2012 so Congress has already had more than five years to find a legislative solution. The only thing it has done in those five years is sue the Obama administration over the program.

The solution here is not to give Congress X number of months for a replacement, but to instead leave the EO in place until Congress has passed a replacement bill. Then reverse the EO.
