Discussion: Kobach Wins Effort To Keep Damaging Deposition Video Under Wraps

In my expert opinion, this decision is, to use the legal term of art, bogus.

Fine. His opponent should make an ad using South Park-style animation to deliver the content of the deposition transcript.

No matter. His fight to keep it out of view is in the headlines.

Laura Kelly can now say: “his performance was so embarrassing that he went to court to keep you from seeing it.” Kelly can characterize it pretty much however she wants to. “Kobach looked incompetent” “Kobach couldn’t answer basic questions about his job” Etc.

Something for the Democrats to go to town on, every day, every hour, every minute from now to November 6th: What is he afraid of? What does he have to hide?

I am in awe that the people of KS seem to be on the verge of electing this sweaty, lying POS. He is as trustworthy as an evangelical preacher with a mansion and a chauffeur. He is second only to Trump as an example of a dumb guy who keeps failing upward. I don’t get it and I never will.

They elected Brownback twice.

Apparently they are in that special class of people who keep trying the exact same thing and hoping for a different result.

Any rule against having an actor play Kobach using his own words in the deposition in an ad?

Just a guess, but allowing the public release of court testimony in this case could open the door to the same in future legal trials. Especially for political purposes, that allowance can be grossly abused. As much as i hate to say it, especially in this case, this decision does not surprise me. This could have been a case of be careful what you wish for. It’s awfully hard to predict every eventuality. but where abuse of freedoms can occur, it will. The GOP is a living, breathing example of that. I’d rather not be the one to open that door. As much as it would help our cause right now, it could also be used against us in some future litigation/campaign.

As i was writing that, i caught myself pondering the increasing irrelevance of worrying about such things as the future. Everything that is important to this country is on the line right now.

and when the trial was over, the judge ordered Kobach to take remedial classes in Trial Law, don’t forget that part.

Bill Clinton’s deposition video was released to the public over his and his lawyer’s objections.

Why is that not precedent in this case?

How could I? I’m still finding empty cans of Schadenfreude around the house and yard from the big party we had after that hit the news.
