He actually made a pretty damn compelling case that the statute allowing for interim appointments of principal officers (i.e. those that report directly to the president) is unconstitutional.

If Conway’s right–and I think he is–Mueller would be entitled, indeed bound, to inform Whitaker that he cannot accept Whitaker’s supervisory authority, let alone any attempt to fire him.
Trump would then have these choices:

Get Whitaker to fire Mueller, with huge and messy consequences that could include Mueller refusing to accept the validity of the termination and being physically dragged out of his office.

Get Whitaker confirmed by the Senate, which would certainly involve hearings and an uncertain outcome.

Go to Court for clarification of the constitutional situation, which would require Thomas to reverse himself.
Given that the price of his transgression will the denial of marital duties, I think it is a fair trade from his perspective…
And now it’s being reported that Whitiker was involved in a company the FTC labeled a scam. So he’s just Trump’s kind of guy.
