Kavanaugh says courts must stick to the text of the Federal Arbitration Act and “are not at liberty to rewrite the statute passed by Congress and signed by the President.”

I wonder if he’ll have that same opinion that it is the clear text of the law that governs when it comes to the numerous violations of law by Trump and company.

Sadly, the court continues to give the Federal Arbitration Act much more scope than was intended originally.

When Democrats re-take government, reining in the act should be an important priority.

No. That is totally different than “the courts rewriting.” Clearly the President can rewrite laws passed by Congress. How else can a Republican President gifted by God to the people of the United States govern?

I actually think he’s going to surprise a lot of people by not being the rubber stamp we’d all assume he’d be. Kav strikes me as, ironically, the kind of to the manner born, prep school snob who’d look down on PP as being a fat, boorish, embarrassing lout even though they’re two sides of the same coin. I won’t be surprised whichever way he goes.

I tend to agree. Watch Gorsuch and Kav both flee from Trump, trying to eliminate the taint. It will never work, especially for Kav - just ask Clarence.

Roberts is establishing a covering record. Give Kavanaugh opinions to write where the court is in agreement, so that he’ll look non-insane.

I really don’t care, do you? He still has that fuckface look about him. He’s an embarrassment to have on the court no matter what he does or doesn’t do. There’s nothing redeeming about having a sexual predator (make that two now) on our high court.

On the other hand, it means that every single other Justice got to review the Opinion and demand any change she/he liked. So, for me it is an indication that he is kind of on a leash, yet.

And not at all the Legal Titan that the Bushes and Orrin Hatch and the GOP scum tried to convert him into, from the Starr Investigation’s Rogue Low Road Delving Asshole.

And here I thought it was a case concerning whether Lite Beer from Miller tastes great or is less filling.
