If the ABA model code, used in most states, applied,he’d have a lot to answer for. There is something wrong with allowing the federal judiciary not to have a well functioning disciplinary system. It’s hard when they’re judges for life, which generally I’m fine with, but there should be some clear code and a disciplinary body able to censure or otherwise hold an errant judge up for public awareness. Given some of the egos on that bench, it might be useful.

There is an obvious jurisidictional problem in making ethics rules apply to the highest court – a lot like the presidential indictment question – but most people look at that as a reason why justices should be particularly circumspect rather than high-fiving and shouting “No rules for us!”

Imagine being appointed to the Supreme Court judge appointed by the most scandal ridden administration in modern history and having your ethics complaint dismissed on the same day as the Flynn stuff.

Yep. And certainly that has been the GOP playbook for a long time. Once you’re in charge, you can change the law you broke. And break the system to make sure no one can unseat you.
