Hmm I wonder if that could be because one of the principals blabbered his fat clown mouth on Fox and Executive Time Friends this morning and not only declared Cohen a liar, but completely undercut one of Cohen’s core claims in the case.

I’m really upset at the prospect of the special master (or worse yet, Cohen’s team) being allowed to make designations about ā€œresponsivenessā€. As I believe the judge herself said, this isn’t a subpoena. If it’s not relevant to their case, and it’s not protected as privileged, why would it matter if the prosecutors saw it? All that exists here is the potential for evidence of other crimes to get buried as ā€œnonresponsiveā€.

Always remember that the master appointment represents an exceptional concession to Trump and Cohen, who have basically said that a taint team composed of public servants would not be trustworthy. Wood has to be very careful that the special treatment idea does not get out of hand. Already we see that Cohen and Trump are attempting to get documents other than privileged ones excluded from prosecution scrutiny on the basis of privacy and relevance. That’s bullshit that the judge must shut down. There can’t be one rule forMAGA folks and another for the rest of us.

Retired federal judge. Former prosecutor. Sounds like an appropriate choice.

And this is the way to go. Don’t want the bad folks to skate because the judge, or the government, tried to cut corners.

I’m pretty sure that’s how warrants are supposed to work. If there’s an intentionally high bar for seizing a lawyer’s records, that whole premise of there being this high bar would be undermined if there’s a backdoor way to turn any seizure into a wide-ranging fishing expedition.

Does it? Seems to me all the special master does is move the review from the DOJ to the court, right? I don’t see any problem with that.

I’m thinking that all this buys Cohen (and Trump) is a little extra time to cogitate on his perfidy and perhaps a little more knowledge of what the prosecutors are relying on as evidence. If I read the accounts properly, the SDNY will be able to challenge, on a case by case basis, any documents that are held back from them by the special master.
