Discussion: Judge Appoints Special Master To Review Seized Cohen Docs For Privilege

I believe the judge has done very well so far in her decisions. This latest ruling cuts the legs right out from under the special pleading going on around the taint team and the biased FBI. Please proceed.

My understanding was that this was going to take longer to be decided until Donnie opened his fat mouth today and basically said that Cohen acted as his attorney only on very few occasions, which caused the prosecution to drop their objections and say they were perfectly fine with a special master being appointed

The argument came in a footnote on a letter notifying the judge in the case that the prosecution now supports the appointment of a third party “special master” to review the seized materials for potential privileged documents.

Pretty bad day for Trump and Cohen. There won’t be much that turns out to be privileged because Cohen wouldn’t have the discipline to label, mark or structure documents and matters as such. In addition, Trump and Cohen are downplaying the amount of legal work because they’re confused about the process and which angle works better. Their interests are not aligned and it shows.

I am happy that Judge Kimba Wood recognized that the defendant and the privilege holder Preshitident Manslut-Peehooker were both accused of serious crimes and had longstanding with ties to mob and the Russian mafia. It is apt that she appointed Barbara Jones, a former mob prosecutor, as Special Master.

Not saying it’s problematic. Saying it’s a highly unusual step the court took in order to protect itself from being attacked by MAGA and Trump as being part of the deep state etc. Trump’s statement that he finds the master appointment ‘acceptable‘ is another implied threat against the legitimacy of the court. The court decides what’s acceptable, not Trump or Fox. I hope that the judge understands that she will be attacked by them no matter what she does. Throwing them a bone makes no difference.

The regular “taint team” process is perfectly defensible and the lawyers for Trump and Cohen didn’t make any real case for why a Special Master would be necessary – nevertheless, I think the judge made the right call here.

It takes away any argument about the DOJ being unfair to Team Cohen and Team Trump (currently aligned, but likely soon to part ways) and puts the responsibility squarely on the court-appointed special master, and therefore squarely on the judicial system itself, not the executive branch DOJ.

And since (I assume) any disputes over whether specific items are being properly included or excluded will ultimately be decided by the judge anyway, what we’re talking about at this point is winnowing out the disputed items from those that both sides agree are properly included or excluded.

While I’m sure the “taint team” approach would have worked fine, I’m confident a competent Special Master will do fine too, and it’s clear the prosecution is going to carefully monitor what Teams Cohen and Trump try to get excluded and will challenge those exclusions as necessary. I’m sure TC&T will try some bullshit, but hopefully the judge will shoot them down.

For what it’s worth, a cynic’s take on the judges order is that she had a friend she wanted to throw a little business. That is there will be a hefty fee associated with the Special Master. Judges are known for appointing trustees and the like for similar reasons.

I’m not sure how I feel about this. I don’t like the idea that Cohen is getting special treatment because of who he is, or who Trump is. My understanding is that “taint teams” are standard operating procedure for determining privilege issues, and that if they determine that something is not privileged, then Cohen/Trump would have the opportunity to challenge that finding in court before the material is turned over to the investigative team. Why should this process be any different from any other defendant’s? On the other hand, a special master seems like an appropriate way to address privilege issues in the first instance. It just isn’t clear to me what the process is for challenging any determination she may make, and I certainly don’t want her making any decisions at all as to whether anything is relevant to the investigation, she cannot be privy to the entire investigation, and making arguments as to relevance will only tip off the defense to areas of investigation.
