Not necessarily. The grand jury decides whatever questions are put in front of it. My sense here…and maybe it’s from something I read previously, but I can’t point to it…is that the prosecutors didn’t even present the jury with the question of whether he should be indicted on what I think could be any number of variations of terrorism charges.
It is really hard under current law to charge someone with domestic terrorism. There are people workng to change that; there was a story in the past year about the legislation failing but I forget the details.
