The federal government owns less than one-third of the land on the southern border. The rest belongs to other entities, including states, Native American tribes, and private individuals. Most of the border land in Texas is private property.

Not a problem, said Trump: “You have to use eminent domain,” he declared. That’s when the government forces a property owner to sell, at a price set by the government. “If we had one person that wouldn’t sell us…then we wouldn’t be able to build proper border security because we’d have that big opening.”

“I think it’s a fair process,” he added.

And what happens if Trump can’t seize people’s land with normal eminent domain? That’s where the “military version” comes in:

Trump and many of the other GOP miscreants (including my favorite, failed porn star and American hero - according to former TPM reporter Lauren Fox* - Michele Fiore) praised Clive Bundy and his merry band of genetic defects for breaking the law and threatening federal law enforcement officers. What are they going to do when landowners on the Texas/Mexico border start aiming their long-range rifles at their own sorry asses?

Can’t we use eminent domain to seize like a foot-wide strip of land across the middle of each golf course Individual-1 owns, then build a big, beautiful steel slat wall fency-thingy across it?

I’ve seen a lot of stuff happen in organizations when some idiot higher-up insisted on doing some dumb thing. People go through the motions, rolling their eyes, because the thing it’s in service of will never happen. Always imagined the Department of Justice was a skosh more serious than that, but this is very enlightening.

When can we raise the lease rate?

My reading of this is the military can seize lands from property owners if they’re deemed necessary for a national security reason. There are some hoops to jump through, but in the end should they choose they can just take your land, and the owner’s latitude to dispute or refuse being exceedingly minimal.

Would be quite interesting if the federal government started condemning private property along the border then never did much more than that…
