Republicans will lose whatever they do.

This from Kevin Drum of Mother Jones:

“The court is split 4-4 between conservatives and liberals. So even if Republicans refuse to confirm a new justice, Obama’s laws and executive orders are safe for another year in any case for which the opinion hasn’t yet been finalized. You can’t overturn an action on a 4-4 vote. This means that EPA’s carbon rules are probably safe. Ditto for Obama’s immigration executive order. Union shops in the public sector are probably safe. Abortion restrictions probably won’t go anywhere. One-person-one-vote is probably safe.”

According to news reports, a priest was sent for when they found Scalia dead. Fat Tony didn’t get the last rights and make his last confession. According to Catholic theology, Fat Tony is in purgatory. You have to have the last confession / last rights to go directly to the pearly gates.

Given the level of dysfunction already plaguing Washington, adding to that by leaving a SCOTUS seat empty for well over a year – which will surely result from delaying replacement until Obama’s successor is seated – will be a sure road to a serious Constitutional crisis and even further dysfunction. The adults in the room need to take control and let this process move forward.

obstructing the appointment is a good thing in the long run. a massive dem turnout will be a huge boost all the way down the ticket. the gops haven’t figured out how fucked they are. they would be better off giving obama the appointment that is his presidential due.

One of the most devastating SCOTUS failures of all time, Antonin Scalia has finally done something really good for America by breathing his last breath. It’s a cause for celebration, and I hope that we will be celebrating Scalia’s demise for many years to come,vis-à-vis the extremist toady’s replacement on the court to be named by President Obama and confirmed before his 2nd term ends. One down, three to go.

I’ll repeat the comment that I made on another post. It would be a grave risk to the Republic not to have a full 9 member court at the time of the presidential election, in the event the results get tangled up in the courts as happened in 2000. Democrats should certainly hang this single argument round the necks of the Senate majority. Do you really want to risk this? Better off for the Republicans to try and influence Obama’s choice.

On the other hand, if the court had only had 8 members in 2000, the ruling of the 11th Circuit would have stood. The 11th Circuit had, the day before SCOTUS acted, unanimously sided with Gore. If SCOTUS had only had 8 members in 2000, Gore might have won the recount.

Is this true? I thought the president’s executive orders on immigration and greenhouse gases were frozen pending a Supreme Court decision.
