“In America, even sincere and long-hold religious beliefs do not trump the constitutional rights of those who happen to have been out-voted,”
I really wish the SCOTUS operated as if that was true, but I’ll take good news today wherever I can get it. Congrats KY!
In America, even sincere and long-hold religious beliefs do not trump the constitutional rights of those who happen to have been out-voted,"
OMG, somebody’s really going to make Mrs. Alito cry…
Falling like flies.
(and i don’t mean zippers)
With everything else that seems to be getting worse before it gets better, It’s pretty cheering to a progressive to see this area where the society is making lots of, you know, progress.
Kentucky should declare that it has religious beliefs that trump the Constitution. If a corporation can be a person, why not a state?
Well, it’s been a no-brainer ever since Scalia showed the way. Once same-sex marriage is seen as an Equal Protection issue rather than a moral one, there is no way bans on same-sex marriage can be considered constitutional. It doesn’t matter if it’s a statute or a state constitutional amendment or whether it’s voted by the legislature or by referendum or if God herself decrees it. It won’t pass constitutional muster. Period.
I’m so excited, thrilled really. It’s just a matter of time before all the walls come tumbling down and LGBTs are finally afforded the same rights the rest of us enjoy. Thank you, Judge Heyburn.
Another one bites the dust
– Freddie Mercury
“In America, even sincere and long-hold religious beliefs do not trump the constitutional rights of those who happen to have been out-voted,” U.S. District Judge John G. Heyburn II wrote in the ruling, according to the Courier-Journal.
That, in a nutshell, is the greatness of America. We don’t always live up to that greatness, but we should never stop trying to fulfill that mission.
Oh my, that “even since and long-held religious beliefs do not trump the constitutional rights” language sounds like a slap at SCOTUS.
except when we’re talking about women’s rights to control their own bodies/snark
Beat me to it!
Is this what they mean when they say: “The South shall rise again”?
If so, I’m cool with that. Once again, a judge got it right.
The bible belt is having a full-bore collective conniption. Don’t ya just love it?
When the walls, come tumblin’ down…
When the walls, come crumblin’ crumblin’…
When the walls, come tumblin’ tumblin’ dowwwwwwwnnnnn…
The South won’t rise again. Jim Gaffigan figured out why.
Boom goes the dynamite. It would have saved us all a lot of time and hassle if the SCOTUS had simply struck down all bans (ala Loving v. Virginia) as part of the Perry ruling instead of dismissing on standing.
Particularly since corporations are, by definition, state creations.
Good times:
IT IS HEREBY ORDERED THAT to the extent Ky. Rev. Stat. §§ 402.005 and
.020(1)(d) and Section 233A of the Kentucky Constitution deny same-sex couples the right to
marry in Kentucky, they violate the Equal Protection Clause of the Fourteenth Amendment to the
United States Constitution, and they are void and unenforceable.
