I don’t know the technical legalities of this issue. I do know that Whitaker is manifestly and inarguably unqualified for the position, just another gritting hack elevated to protect our grifter in chief.

New acting Attorney General Matthew Whitaker said in 2014 that judges without a New Testament “biblical view of justice,” should not serve on the federal bench and suggested that he would block the appointment of non-Christian judges if given the chance.

While Whitaker singled out atheists in particular as being unfit to serve, his comments also extended to Jewish and Muslim Americans.

Well if the administration’s argument is that Whittaker is NOT a principal officer than Whittaker should be precluded from exercising the powers of a principal officer…in other words he can only maintain the status quo until a replacement is nominated and confirmed.

I thought firing Sessions was supposed to be a red line for Senate Republicans. Can they require immediate confirmation hearings for Whitaker and then reject him? The sooner the Republicans learn to say “NO” to Trump the less damage he can do to their party and more importantly, the country.

Nop way this bastard would ever be confirmed by the Senate, so that’s why Trump is doing it as interim. But what kind of death wish does Whitaker has to accept this role? What’s in for him? He is going to get his ass roasted on day 1 of the new congress no matter what he does.

To find one of the precedents they needed, the authors of the memo released today had to go back to the Civil War era.

And their precedent happened two years before Congress created the Department of Justice.
