I’ll wager that since we civilians can’t possibly know every technicality in every law of the land, there’s probably a way around every crime under the sun when it comes to presidential authority. It’s just that it so seldom comes into play, but it’s probably true that whatever we see as transparently unethical, unconstitutional or illegal has some arcane loophole buried a mile deep in some obscure law. It’s infuriating, but it’s probably going to allow Whitaker to derail Mueller and essentially puts the entire Mueller probe into Orange Julius Caesar’s tiny hands.

Well if the administration’s argument is that Whittaker is NOT a principal officer than Whittaker should be precluded from exercising the powers of a principal officer…in other words he can only maintain the status quo until a replacement is nominated and confirmed.

This may be the intent.

It basically dares Mueller to try an indictment, the administration can say that Whitaker cant approve it, and Rosenstein can’t because we have an acting AG.

Mueller will want to be sure any indictments stands, so he may hold back.
