The law, the Constitution, and Supreme Court decisions apply to other people and do not apply to the Department of Justice.
Iāll wager that since we civilians canāt possibly know every technicality in every law of the land, thereās probably a way around every crime under the sun when it comes to presidential authority. Itās just that it so seldom comes into play, but itās probably true that whatever we see as transparently unethical, unconstitutional or illegal has some arcane loophole buried a mile deep in some obscure law. Itās infuriating, but itās probably going to allow Whitaker to derail Mueller and essentially puts the entire Mueller probe into Orange Julius Caesarās tiny hands.
I read yesterday that Ed Whelan wrote this defense. You remember Eddie, donāt you?
Unfortunately, thatās not true, because once the DOJ issues a memorandum of this kind, it lives and lives.
If heās advised to and doesnāt recuse he shreds his credibility for life.
Good luck Matt!
Not just that. Depending on what he does, there are also the Obstruction of Justice charges that could be brought.
This is just another ridiculous document saying, basically, āThe President can do it.ā
What matters is whether Whitaker recuses.
Thatās not the point.
Heās seriously biased against a lawful investigation into possible treason by the person who appointed him.
Recuse. Or, hell, just surrender to Putin already. Stop the lies.

He may have done that a while ago.
Many people are saying.
I was just thinking which casting agency sent him over from their ābig doucheā pickings. Must have been a little sad to see him go.
Indeed .
If you didnāt see this "Closer Look " take 10 to watch 5 *****
I do not believe there was any credibility to begin with.
Heās another unqualified toady
O they can probably find another. America seems to be running over with big douches at the moment.
No question. But big douche futures are tanking.
DOJ Argues Trump Has Authority To Appoint Whitaker As Acting Attorney General
Entirely:
a) Expected; and
b) Wrong.
Thatās true so they better hurry if they are going to replace Whitaker.
This may be the intent.
It basically dares Mueller to try an indictment, the administration can say that Whitaker cant approve it, and Rosenstein canāt because we have an acting AG.
Mueller will want to be sure any indictments stands, so he may hold back.
Letās go to court. If this is in fact true then the next Democratic president should bypass any republican senate for appointments.
Sure. But Republicans have exactly zero motivation to do so. They are getting what they want and/or are too afraid to stand up to him. They are not a party. They are a cult.
Was it drafted at Whitakerās direction? Would he have allowed itās release or been able to block it should it have said otherwise?
