It’s probably not a copyright violation, it falls under fair use. If TPM had picked a random photo to illustrate the story that would be a copyright issue, but in this case the photo is the story. As far as citing the source it’s not really relevant to the story and adding a credit in the usual place below the photo might actually be confusing. PS I write this as former photojournalist / political campaign photographer.

I’m not sure he has a strong backing in the LGBT community. Maybe things have changed but when he rode in the Gay Pride parade this year, there was a strong contingent among the LGBT community who turned their backs on him as he passed and they promoted this shunning on Facebook. I don’t think there are many in the LGBT community who wil vote for him over Peters just because he is gay. He has been endoesed by too many homophobes.

Asking permission is secondary to actually obtaining it in writing. Anything short of her signature on a waiver entitles her to oodles of compensation.

In United States copyright law, fair use is a doctrine that permits limited use of copyrighted material without acquiring permission from the rights holders. Most importantly, the woman in the photo is not Kate Lyon and is, instead, merely some random person entirely uninvolved with the DeMaio/Peters race. Therefore the photo has no relevance as commentary on a news story. There may be no grounds for a suit if this woman signed a waiver to permit this image to become a stock photo, but if she did not sign a waiver, then DeMaio is very much liable for defamation if this woman chooses to contend that her reputation has been damaged.
He is widely opposed in the LGBT community, who despise him because until it was convenient he voted against gay interests and took lots of money from backers of Prop 8. He’s regarded as an embarrassment to the gay community in San Diego.
It’s actually three scandals to date, this plus two related to public masturbation.

Scroll down the TPM post - Carl DeMaio used the image in an email. The photo was the story, to all intents and purposes.

I don’t follow you. DeMaio wrote “Kate Lyon” and used this anonymous woman’s photo to suggest that Kate Lyon was of similar girth. The photo is not the story – DeMaio’s reckless slander is. If some elected official, say a federal judge, wrote “Barack Obama” on an email and attached a photo of a gorilla, would the gorilla be the story, or would the slanderous attitude of the judge be the story?
