Republicans keep offending anyone and everyone under the sun. It is as if they trip over each other to be the first in line to offend others. And yet they tell us that they are the Party of the Big Tent.

Has anyone ever told DeMaio he needs to seriously grow up? I’m guessing no. This is not the kind of behavior we look for in our elected representatives. At least I don’t.

Both indicate this guy has the mentality of a drunken teenager trying to get elected captain of the wrestling team.

I think we now know why the GOP makes up less than 30% of the political demographic in California. All of the decent Republicans left the CA GOP and this is all they’ve got left.

No, it’s not a copyright violation. It falls quite squarely within the scope of “fair use” as part of a news story. You can debate whether publishing the photo was in good taste, but it is not copyright infringement. Not even close.

No. It isn’t a violation of the right to publicity, either. It’s a news report discussing the use of the photo. Publishing the photo as part of the report is not a violation of the right of publicity, nor is it a copyright infringement.

That is not “more to the point.” It is a different point.

A right of publicity claim typically does not apply to “newsworthy” uses of a persons name or likeness and is instead usually focused on use of someone’s name or likeness for marketing purposes.
