Discussion: Court Rules Florida Can Stop Doctors From Asking Patients About Guns

Discussion for article #225671

Corporations are people who have 1st Amendment rights, but doctors are professionals who don’t have those same rights.

That makes sense to me!

Pretty sure the 1st Amendment comes before the 2nd…

Where is $arah pay-stubs outrage at this Government intrusion on FREE SPEECH?

They don’t ask if I own a car or have knives or other sharp objects in the house. Those don’t pose health risks?

Not in BaggerLand it doesn’t – unless, of course, we’re talking about BAGGERS’ first Amendment rights!

Rick Scott has a special case of megalomania. Throw in guns and abortion and the poor physician must share their privileged relationship with patients. I wonder if a lawyer can ask their clients about gun ownership?

Can a knife kill someone across a crowded room?

Can you conceal your car in your back pocket before you walk into your estranged girlfriend’s apartment?

Can you kill or maim someone with one unaimed slash of your knife?

How far do you think you could drive your car into a school or a post office or another large place of business before a wall literally stops you in your tracks?

Do knives and cars have lobbying organizations (and, apparently, internet trolls) that belittle or dismiss any incidents where people are killed by either a knife or a gun?

So, should Seagrams push for a law to prevent physicians from inquiring into a patient’s alcohol intake?

That’s why it’s called Flori-DUH!

Ooohh-nice point!

Something like 85% of suicide attempts with guns are successful. This is mostly about preventing suicide. How do questions a doctor asks affect your 2nd amendment rights in any way?

Same as it always is. These cases are “Judge shopped” in this case the two GOP’er appointees, one by Ford the other GW Bush went with the law…and the Clinton appointee was in decent. Of the 10 active judges on that court 70 % were appointed by Democrats. Yet again, just as the “3 Judge review” of the ACA subsidies a court that is 2/3 liberal sets up a 2/3 Conservative “panel” to review a law tightly joined to conservative politics.

Its going to go the way of the Judges politics. The law doesn’t mean shit.

Teh Stoopid is running deep in the 11th Circuit.

The NRA must be shitting its pants out of joy.

Wasn’t it the conservatives that said, and still say: " Keep the government from coming between you and your Doctor."
Now, they want the Government coming between a patient and their Doctor?
I’m sort of confused by their logic.

I guess the First Amendment only applies for speech the right-wingers approve of.

That, as well as accidental deaths or injuries, I should think, especially if there are young children in the household. That is every bit as important to discuss with a patient as his/her diet and exercise regime.

Post hoc: Of course, if this stands, and other states adopt similar laws, I suppose we have another naturally-occurring experiment on what allowing physicians to ask this question has on the rate of gun-related suicides and accidental deaths, just as we now have such “experiments” going on regarding the raising of the minimum wage and the expansion of Medicaid. (sigh)

(Cough) I’m hoping you meant “in dissent” and not “indecent.”

My doctor asks how much I walk versus driving, which pretty much asking whether I have a car. Pediatrician reminded us to put a lock on the sharps drawer in the kitchen. Also asked about hobby woodworking.

If this law goes into effect, countdown to the first doctor sued for not telling some idiot to keep guns away from their children.

Actually, my GYN asks whether you use your seat belt, for the same reasons.
