So let me get this straight: Trump wasn’t aware of the agreement, even though he (under a threadbare alias) was a party to it? And the agreement provides that it will become effective only when signed by all parties? Is that your story for today?

Ok, IANAL, but, 1. I don’t think anybody believes this and 2. Can you do that? Negotiate an agreement on behalf of your client, but not actually inform your client?

No lawyer here, obviously. Would one weigh in please? I seem to remember commentary somewhere that it’s either illegal or against ABA canons for a lawyer to disburse money to someone on behalf of their client without their client’s knowledge or permission. Is that true?

It’s much like the NRA taking millions of dollars from Russia and moving it to political action accounts and then–voila!!–it’s all legal because Russians didn’t contribute money to Mitch McConnell’s campaign. How completely insane.

Sounds like he’s going to take one for the Cheeto. He’ll probably get fined and disbarred, but he’ll have the eternal* gratitude of Donald J. Trump.

Under the Model Rules of Professional Conduct (which NY has adopted), attorneys have an active duty to “promptly inform the client of any decision or circumstance with respect to which the client’s informed consent… is required.” In this context, Informed Consent is defined as “the agreement by a person to a proposed course of conduct after the lawyer has communicated adequate information and explanation about the material risks of and reasonably available alternatives to the proposed course of conduct.”

If this admission is true, Cohen has most certainly put himself at risk of being disbarred.
