Discussion: Cohen's Lawyer: Trump Was Not Aware Of Stormy Daniels Hush Agreement

Based on Cohen’s logic, he could sell one of Trump’s buildings and not tell Trump about it, but it’d be a valid sale. What a total dumb ass, unethical scumbag.

When nothing you say passes the giggle test, you’re a really shitty lawyer.

Maybe they feel like they have to take this position, because the whole point is to try to protect Trump at all times…but this nonsense severely undercuts the validity of the NDA and helps Stormy’s case against it. Here you have an agreement with a signature line meant for Trump to sign it, and yet one of the other signatories, who was the person obviously intended to obtain Trump’s signature, claims Trump never even knew about it. How is that not a fraud in the inducement upon Stormy, who was clearly led to believe she was signing something that Trump was a party to? There can be no “meeting of the minds.” Cohen’s argument will be that it should still stand as a contract between him and Stormy, with Trump as an intended third party beneficiary, but that’s garbage when you have a fucking signature line sitting right there for Trump to sign as a direct party. These people are so stupid and goofy it makes my head hurt.

I gather Cohen thinks he’s within the rules because it wasn’t (ahem) Trump’s money that was proffered as settlement. No?

I laughed when I saw that clip last night. That moron even sounded like bragging when he was showing to the world he is a shitty lawyer fucking his client and his client’s client. What an idiot. Really. Wow.

It makes perfect sense to pay someone $130,000.00 to refrain from talking about something that never happened.

Isn’t Trump a party to the suit against her for breaking the agreement? If he wasn’t a party to the agreement/ didn’t know about it, how can this be?

An intended third party beneficiary can under many circumstances sue to obtain specific performance (i.e., enforce the contract and make the other party do what they contracted to do…in this case, keep her mouth shut).

If he isn’t party to the agreement, there isn’t an agreement. Cohen doesn’t receive the benefit, only Trump does. So a contract between Cohen and Daniels that doesn’t benefit both parties, isn’t a contract.

So, assuming they stick to this story, Daniels is free to tell her entire story and reveal any evidence she has. Cohen will also end up disbarred and probably charged with a felony or two.

So its a really dumb move on every count. It accomplishes nothing for Trump except to let him deny there was an affair for a week or two until she starts dropping photos and texts.

Wow…the law must be getting close…Donnie was not ‘aware’ and he never had ‘sex with that woman’ and ‘he knows nuffink’…what is truly amazing is the number of people that will lie for this buffoon. His whole life has been one big ‘take care of Donnie’ series of moments. I can’t believe there is an instance that I would protect him.

The “affair” entailed by Daniels’ own admission a single sexual act upon their initial meeting, followed by sporadic meetings to do…stuff(?). I’m going to assume Daniels didn’t come prepared to film or have photographed that initial dalliance. Seemingly any communications afterward, while embarrassing, wouldn’t confirm they were conducting an “affair”, at least not in the sense most adults understand the word to describe.
Personally I don’t think she has squat, or at least not much.

It may have been worth $130,000 grand pre-election to keep all this quiet, but now that the cat is out of the bag he screwed her, and everyone believes he screwed her, I fail to see what she holds over his head going forward.

Stormy Daniels’ attorney, Michael Avenatti, is going to end up with many new clients as the NDA falls apart like so much wet tissue paper. Hopefully there will be enough of them for Donnie Diggler to find out that “class action” is not what he thinks it is.

Ummm…not to invoke Bill Clinton, but depends upon how narrowly or broadly you define “sex”. Billy-Boy insisted a BJ was “not having sex” with Lewinski, although a lot of folks would see it thus. So if they define “sex act” as actual (vaginal) intercourse, that doesn’t shut out other kinds of “play”.

Are they playing games with us? Wanting people to ask what “stuff” they kept meeting for in hotel rooms??

Perhaps she just spanked him every time? Or made him wear diapers?? Could be a whole lot of “stuff”… more in the line of the “pee pee” tapes.

That would be even more dynamite than a garden variety romp between the covers. And could explain why he’s so tetchy about it.

And what’s more, the whole argument that Trump was a third party benny is just fucking ridiculous. The agreement gives him obligations too. It contains language by which he releases her from all liability (other than the agreement itself of course) and promises not to sue or to go to the authorities (language obviously put in there to help them argue it was all blackmail on her part). This was part of the consideration she believed she was receiving. Nobody in their right mind would sign the fucking agreement if they didn’t believe that Trump was giving up the right to sue or anything else. For Trump not to even know about the contract not only means there was a failure of consideration, but that failure of consideration, despite the language in the contract, become part of the fraud in the inducement.

Frankly, the next person she should be suing is the attorney who represented her with respect to that agreement…after she reports him to the bar.

Cohen - or Cohen’s lawyers will continue to spew incoherent, ambiguous, nonsense - all will be like shoving bags and bags of ice cubes down a garbage dispose-all - will grind away for a while - make lots of noise - but produce nothing but water that goes down the drain & disappears .

Some how - amazingly - Trump has been muzzled on the Stormy matter - and if he stays mute on this - it makes a bunch of noise & goes down the drain … unless it can be finessed into court - and Trump’s side is not going to push that - they will rattle sabers but not press for court dates - and after they let the air out of the balloon a bit - they will release Stormy from the agreement - maybe even let her keep the $130K

Basically Trump may have already survived the the ‘stormy’ weather - His base & the larger GOP has either said - "she is lying " - or - “so what, he is a disgusting piggish - horn-dog and we absolutely don’t care”
