Please, please, Congress take over. It will happen. It’s been building and now, what choice do they have? They cannot let this go under any circumstances or the Dems along with the Rethugs would be doomed.

That statement is what they are going to be sending to any courts that question subpoenas, and they can point to Mueller’s statement as the reason why they have to be able to investigate beyond what the DoJ can do. It’s obvious of course, and BS to argue that Congress requires a legislative intent to do anything, but this really makes the case crystal clear. And it should also make it clear politically…makes you wonder if there was some discussion about this beforehand, since Nadler’s statement came out so quickly.

not in terms of precedent regarding executive privilege, it doesn’t.

The statement is worthless. It doens’t advance the arguments in the “easy” cases (Mazars, Deutsche Bank, taxes) or the hard ones (executive privilege, access to grand jury materials, etc).

Here is a crucial excerpt from the “Fast and Furious” case that allowed the House to gain access to privileged documents despite “executive privilege” claims…

Therefore, the Court finds, under the unique and limited circumstances of this case, that the qualified privilege must yield, given the executive’s acknowledgment of the legitimacy of the investigation, and the fact that the Department itself has already publicly revealed the sum and substance of the very material it is now seeking to withhold. Since any harm that would flow from the disclosures sought here would be merely incremental, the records must be produced. The Court emphasizes that this ruling is not predicated upon a finding of wrongdoing.

in other words, the first “special circumstance” is decidedly NOT met – unlike in the Fast and Furious case, Trump is saying the investigation is illegitimate.

the second special circumstance could be read either way – and Trump will argue that the stuff it wants to “withhold” is the stuff whose “sum and substance” have not yet been revealed.

Why did Mueller say he thinks the DOJ ‘no charging the president’ regulation is unconstitutional. That seems pretty significant.
