I think that was based on convincing the jury that use of his material constituted endorsement by him. He sued because he did not endorse the McCain candidacy but was falsely portrayed as doing so. What I’m saying is just playing the song… as I am doing with ZZ Top right now…is not a copyright infringement. You have to take it as your own or for commercial purposes ( sell it ) in order to run afowl with copyright.

There is a general performance license that campaigns can use to get around at least one ‘wall’. However the publishing companies have advised them to seek permission from the artists before going this route.
For what? If I buy your music and play it without commercial gain and do not imply use of it constitutes an endorsement by you…what harm are you trying to remedy? What do you need to be made whole again? From what I’ve read the settlements in these cases are very small or token in nature and not copyright based. Again how is copyright involved?
