They’re previously booked out at Joe’s Bar and Pole Dancers out on the interstate. But the poles are yuuuuuuuuuuge and so very classssssssy.
Gawker has put together a Spotify list of all the songs that were illegally used in campaigns.
2012 - Dee Snider of Twisted Sister asks Mitt Romney to stop playing “We’re Not Gonna Take It.”
That song is currently being used by Donald Trump in 2016.
Due to Adele, this article will need to be updated soon.
I doubt copyright is in play. That applies if you take another’s work without permission as your own or if you use it commercially without the owners permission. There’s a reasonable argument that none of that took place. What Adele could do is condemn the use as she does not support Trump’s ideas and insist he no longer use the music. If it was copyright stuff she could sue.
These days there’s a decent chance she does.
One of the fun things my father, a copyright and tax lawyer, got to do as lawyer for Jerome Kern’s estate was join with Harriet Pilpel, a New York lawyer representing Hammerstein’s estate, in telling NBC that their production of Showboat would not happen if they intended to go ahead with their plan to placate the South by cutting the miscegenation scene.
I’ve seen so many stories like this, over multiple election cycles–and almost always involving Republicans. Is it actually illegal, or just impolite? And if it is illegal, is there any way to enforce it? If ASCAP/BMI are willing to go after local bars for hosting cover bands, then I would think they would be the best enforcers of copyright.
This is the ASCAP pdf in regards to this subject.
Thieves have no respect for other people’s property because thieves.
How is copyright in play? Adele’s objection is not to theft of her intellectual material but the use of it in support of a purpose that offends her.
I keep waiting for someone to send Trump official notice that each and every play is at a cost on 1.2 million. Since the only things besides family that Trump seems to care about is his ego, his combover and his wallet, might as see just how much ego he can afford.
If they bought the CD…its not theft to play it.
There’s a general performance license that campaigns can get from the publishers in regards to this matter. However ASCAP and BMI have made clear that campaign managers should get permission from the artists.
Jackson Browne, David Byrne, Don Henley and Survivor have sued in the past over this.
Maybe not for their own pleasure, but using it to sell a product (themselves) is stepping over a line.
Jackson Browne got a jury to agree with him
Thanks for posting this. Interesting to see that artists can take action even if the campaign has secured the proper clearances.
They sued after cease and desist was not abided. Did any recover?.There is no theft of the material if its paid for prior to use and not used for commercial gain. It may offend the artist and that artist has a right to object. But how many times has there been awards for copyright infringement if all you did was play the song without commercial gain?
From where I sit, hundreds of miles away, I can honestly say that I can’t tell a difference between her singing and yours.
In Law & Order I loved how Lennie always mocked partner Rey for using computers as if they were some kind of passing fad. There’s also a movie I love from 1994 called The Last Seduction in which someone is hired to find the location of an incoming call using a device hooked up to the landline that registers digit after digit during the conversation until the entire number can be displayed. Who would have imagined we’d be here.
Joe Walsh vs. Joe Walsh is priceless! And every single politician on the list (except for Sarkozy) is a Republican.
Only the Browne camp can say whether they issued a cease and desist letter before the suit; but the article reads that no letter was anted up to the McCain camp.
Upon review, David Byrne’s camp went with legal paperwork too.
Jackson Browne, David Byrne, Don Henley and Survivor have sued in the past over this and won settlements. Henley got his settlement via a parody case against Chuck Devore.
Dites-moi pourquoi. . .
