D.C. Federal Judge Tosses Trump Suit To Block NY From Giving Congress His Tax Returns | Talking Points Memo

A Washington, D.C. federal judge on Monday rejected an attempt by President Donald Trump to prevent New York state from releasing his tax returns to Congress. But Trump could pursue the case in New York, the judge said.

The only real question is, when will SCOTUS hear any of these cases? It seems unlikely they would rule in Trump’s favor but, however they rule, their decision will be the only thing that can really bring an end to all of this silliness.

How long can this delaying go on?

SCOTUS will not hear this one.

Note the case was argued in July. It’s now mid-November

“In his lawsuit, Trump’s attorneys argued that the state law was simply an effort to get information about his personal finances to embarrass him politically.“

I had no idea the Chosen One carried the embarrassment gene. None at all

Anyone sick and/or tired of so much winning yet?

I bet Trump is getting there - and this is low on the list of what’s going to hit him this week.

From the article:

The House Ways and Means Committee hasn’t actually requested [Trump’s tax returns] yet

the reporting isn’t quite accurate. The judge still sees at least some of the case as still pending, to wit"

ORDERED that, on or before November 13, 2019, Mr. Trump and the Congressional
Defendants shall meet, confer, and file a Joint Status Report outlining how they would propose
to proceed on the Emergency Application for Relief Under the All Writs Act, Dkt. 6, which
remains pending before the Court.

The writ in question was not thrown out. It asks the judge to come up with some form of relief that would give Trump time to stop the documents from being sent if/when requested.

For all these reasons, the Court should fashion equitable relief to preserve a window for
judicial review. Specifically, the Committee should be required to notify the Court if its Chairman
intends to request the President’s state tax returns from New York. The Court can then convene a
status conference and determine the appropriate process for briefing the legality of the Chairman’s
request. The Committee’s Chairman, accordingly, should be enjoined from requesting or receiving
the President’s state tax returns from New York until the President can obtain judicial review of
the claims in his complaint.

based on this order, I think its safe to assume that the judge wants an agreement reached between Team Trump and Neal that Trump will be given notice before any document request is made. Moreover, it sounds to me like Neal can’t get the documents until this issue is resolved, because this part of the case is still pending.

Of course, because he has nothing to hide, Trump will be releasing his tax returns immediately.

O/T but real reaction: he looks, in this stock photo, like he’s at death’s door.

Damn, that was my first reaction as well: our Miss Clairol Golden boy looks like he’s going gray. And wrinkled.

Not enough tears from the border children to bathe in.

ETA: elsewhere, as others have noted, Josh talks about outrage fatigue. I’m worried that my drive to maintain outrage this week alone is going to destroy my productivity.

No doubt.

This has never ever happened to Trump. So far he has been protected by an array of enablers.

He still is.

But here we have a situation in which, on an hourly basis, his name and those of his Crew will be mentioned. And just about all of it will be negative.

He can’t assert innocence by showing something positive. He is left with throwing negativity and dirt on his accusers. And these accusers are a not the best ones to trash. If that were the case, about a half dozen TV shows would be getting 0 in the ratings.

So let’s say Trump runs out the clock with these lawsuits and ties up his tax returns until after 2020. Is the best case scenario for him winning the 2020 election and hoping that the Supreme Court rules in his favor, or is it losing the election and hoping everyone decides to just abandon the issue after that?

Judge said “You are in the wrong court son. Take it to the NY Courts and ask them if they care, Thank you and have a nice day. Don’t slam the door on your way out.”

If they do, they’ll wait to hand down their decision at the end of the term in June 2020.

He does have that late Chernenko pallor. The Soviets were more fortunate than us in that Chernenko only served about a year.
