Supreme Court Justice Clarence Thomas was discharged from the hospital on Friday after being treated for an infection for nearly a week, according to Supreme Court spokesperson Patricia McCabe.
“I think Justice Thomas could make his decisions like he made every other time. It’s his decision based upon law,” House Minority Leader Kevin McCarthy (R-CA) said Friday.
Sure, Kevin - he could. There’s always a first time!
And, if she was mentioned in any of those documents, or if he and she were worried she was, then that’s a clear conflict of interest. Not that it matters to Thomas, he’s never really cared what the law says when it conflicts with his own personal agenda.
This really does give a clear reason why there should be actual rules around SC justice participation in cases and recusal. If Thomas really was trying to cover for his wife, then that’s a huge scandal and grounds for impeachment…it will never happen because Republicans will refuse to vote out a Republican Supreme Court justice, but that just points out how bad they are. The other thing this does is add even more taint to the current Court, it’s more and more lawless in its decisions and actions…I wonder if there comes a point where Roberts decides he has to step in to preserve the reputation of the SC.

While I agree with the first sentence, we should not say McCarthy got it half right.
Next, Justice Thomas should be released from the Supreme Court. He’s the exact same scumbag today as he was at the time of his confirmation. And obviously before that too.

With all the talk during the Brown Jackson confirmation hearings of “wrongly decided precedents” one wonders if every 5-4 Decision where Thomas was in the majority and that even tangentially related to his wife’s business/lobbying/idealogical interests shouldn’t be reconsidered due to his failure to recuse himself???
I realize there isn’t a “procedure” for this, but sure seems someone could sue to have those cases looked at again.
Unfortunately, even if they were reviewed, the current makeup of the court probably ensures they would be “decided” the same way…so, um, never mind --sigh–
