Casey didn’t need to make this statement but it’s timely because it defuses the rabid left’s attempt to change the narrative to attack Biden instead of attacking Republicans. It also entices people to stay focused on Nov '22, because if we Dems show up and we are persuasive enough to generate a 3 to 6 pt shift among white women towards the Dems over the '20 baseline, we’re going to win the midterms and usher in a sea change in US politics.
One thing I see happening if Dems do win the Congressional elections is momentum developing for a bipartisan solution to codify Roe. GOP won’t want to have the issue as a political football any longer because they are stuck in a position of supporting a national ban on abortion and punishing those who get abortions, providers or those who assist in any way. Nobody likes that crap. If white women swing blue on that issue, they’ll throw in the towel.
One potential compromise I could see out of a centrist working group (mind you I support the women’s health protection act) could be the following:
- No State may criminalize abortion or enable or undertake other criminal or civil actions against those who get, provide or assist abortions, period.
- No State may punish anyone civilly or criminally who crosses state lines to get an abortion or seek birth control or other related medications, period.
- Fed gov’t is empowered to establish family planning centers in any state to provide abortion services. No state may interfere with access in any way.
- A federal abortion standard at 15 weeks will be set. Any woman may seek an abortion at any federal facility on demand within this time frame.
- Any state may meet exceed that standard.
- Any state may choose not to legalize abortion within their borders; provided, however, they must not criminalize, punish or impede persons who seek abortion or birth control either across state lines or from Federal sources.
- All states must allow abortions to protect the health or life of the mother post-15 weeks in any hospital within state borders that provides maternal care services (no defining down or restricting scope).
What this proposal does is it lets Mississippi be Mississippi but it can’t force any Mississipian to live by MS standards. Right wing can’t impose on blue America. Blue America can meet or exceed the Roe standard. Women are not criminalized and they receive life saving treatment when they need it.
If we win I see someone like Sinema, Manchin, Murkowsi, Collins forming a working group to codify abortion rights in this manner.

It is really quite simple. The 14th Amendment states, as matter of LAW, that citizenship and the rights of the individual START at LIVE birth, PERIOD. The fetus has NO rights except as a component of its mother’s body. One can argue on moral grounds that this is wrong-headed but it is the law. If the Evangelical White Supremacy advocates want to change this, they can try to pass a Constitutional Amendment to do so, HOWEVER, until that day, they should just shut-up about it.
The ACLU should petition the Court on the Right to Choose in Texas, by stating ANY prohibition of abortion for a black woman for any reason is unconstitutional, based on the 13th Amendment, NOT on inferred privacy or “substantive due process.” violations which the court states are not enumerated rights.
OK, here is an “Enumerated Right” for you to consider - The 13th Amendment states that:
"Section 1.
Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction."
Pregnancy is “involuntary servitude” if the mother chooses NOT to carry the fetus, (which has NO rights until live birth), to term. No woman, but especially no Black woman, should be forced to carry a baby to term.

They will put something up there to avoid the filibuster being gutted on this issue, as it is key for their brand. What they will sell to the caucus is that a bipartisan bill will have stronger standing with the public and the courts.
Again, if we add two Democratic pro-reform Senators to the Senate, Manchin, Sinema, Collins, et al are IRRELEVANT.
They are not worth wasting a second talking about or giving a shit what they do if we are successful in the mid-terms.

I have grown to love our Senator Casey. I never disliked him, but he was always…just kinda’ milquetoast.
He’s really stepping up to the plate for Pennsylvanians.
Plus, he’s doing his damnedest to get Fetterman and Shapiro elected.

This is the real question. We can’t let the Republicans get away with the “we just sent it back to the states” nonsense. Their goal is a complete national ban.
