The article is about something before a court of law. If there wasn’t a court of law involved there would be no story. My concern is how she weakens the argument of all other women who come before a court of law if such a trivial encounter is to be claimed as assault. I am interested in having people who commit sexual crimes punished by the law, not scolded on internet comments.

Thank you. I have been kissed on the cheek dozens of times in business situations, not once welcome, and have never once initiated such an embrace. In fact, it is offensive to see professional peers who are male receive a handshake while (the notably fewer) females receive cheek kisses. Moreover, business etiquette requires a neutral response at least; to demur could be viewed as impolite or even hostile, with the attendant risk of being perceived as too sensitive, militant, or (you know) not belonging in the professional workplace.

A reminder to all that ‘battery’ is not the same as ‘assault’.

Definition . 1. In criminal law , this is a physical act that results in harmful or offensive contact with another person without that person’s consent. 2. In tort law , the intentional causation of harmful or offensive contact with another’s person without that person’s consent.

I’ve served on a couple of juries related to sexual assault & molestation. Judges’ instructions were very clear on this distinction.

In the US*, in a business situation, it is NEVER okay to kiss somebody. Certainly, if only the women are given kisses you have created a problem.

*This ain’t Italy. And by the way, Italy is notorious for patriarchal misogyny.

ETA: No, no, no, a woman shouldn’t go around kissing the guy at work either. Sheesh.

It’s extremely complicated. I lived in Latin America for many years and although somewhat common in many countries for a man to to greet a woman with a kiss (although not really a kiss, unless a true friend or relative, it’s just a slight touching of the chicks), it’s best to let the woman initiate, guys too eager can come off as creeps.

It varies from region to region, not surprising is more common in larger more cosmopolitan places, in rural areas that will get you stabbed. It’s not done in business settings, but once I was surprised when a client invited me for lunch at his house and his wife greeted me with a kiss.

Have to side with the trumpsters on this one. There’s nothing “forcible” going on in that video. It even looks less so in slow motion.

It’s not the “offensive” part that makes the distinction though, but simply “contact”. From what I understand, assault is the (perceived) threat of that contact.
