Marcy Wheeler pointed out the other day – in her usual, oblique, hide the damn point manner – that Trump’s pardon of Bannon didn’t come until after J6. Which implies that the pardon could well cover what has increasingly become clear as a criminal conspiracy to get the mob to assault Congress for the purpose of disrupting the vote count proceeding.

If so, it means Bannon has no 5th Amendment privilege to avoid testifying.

Most of Trump’s pardons were very narrowly constructed—a result, I would guess, of not having them written by competent lawyers—and didn’t cover anything and everything the pardoned criminal did for Tinkles.

I haven’t been able to find the specific language for Trump’s pardon of Bannon, just a list he’s on of a bunch of people commuted on Jan. 19 for (semi-quoting, not looking it up again) “the matters placed before me.” And I’m not entirely sure there actually is a separate document, although whatever he got was enough to get the We Build the Floppy Wall fraud charges dismissed.

Can someone clear this up for me. Bannon is being charged with criminal contempt here. It is a punishment for wrongdoing. However, civil contempt is often used against recalcitrant witnesses, and it allows the court to fine or jail a person for each day they don’t cooperate. In a case like this, civil contempt can be a more persuasive tool and can even result in harsher consequences. Is it not a tool available to Congress?

I vaguely remember that the Build-The-Wall scam was the only thing he was pardoned for doing.

It is available to them, but they wanted to send a clear and persuasive message to other Trump co-criminals that they are risking prison time if they don’t cooperate.

They also wanted to strengthen the hand of Congressional committees by asserting the legitimacy and power of Congressional subpoenas.
