Steve Bannon’s lawyer presented D.C. Circuit judges with a cornucopia of defenses Thursday as the former Trump White House advisor attempts to get his contempt of Congress conviction and accompanying prison sentence overturned.
Bannon could have negotiated a lesser sentence and saved his lawyer costs. Then serve a short stint and be a martyr for the cause. “Messy Mandela” would at least be able to now sleep at night.
If they work fast – it’s an easy case – we could have an opinion by the end of next month. Guesstimate another 60 days or so for motion for rehearing and rehearing en banc gets you to February. 90 days after that to petition SCOTUS for cert., so he’s up to May. Government opposition in June, Bannon’s reply in July. Court doesn’t start having conferences again until October, but that should be an easy denial of the petition. So maybe a reporting date in time for Christmas 2024?

His time in the federal pen will toughen him up a bit for Sing Sing when his inevitable NY fraud conviction takes effect.

It seems to me there are indeed privileges that could apply.
This sounds to me like Bannon intended to do what he did regardless of the legality of it. Now, he’s trying to use the law to make up a “Yeah, I meant that” as his reason.
Well, OK, if that’s the case. He’ll be a hollowed-out, well-thrashed penitent, ready to work on his poetry, ping-pong skills, and new-found religiosity when finally thrust into the fed-pen. That justice of this sort takes so damn long is ridiculous. It’s a bleeping subpoena violation, not The Scopes Trial.
