Abbott Sued For Ordering Investigations Of Parents With Transgender Children

MO’s former Director and Health and Senior Services already implemented that.

When this goes to court, and I hope that there is a civil action filed against Paxton and Abbott I hope that two yahoos get hit with astronomical judgements.

Obviously what the governor has done is to deputize his dept. of family services to ENGAGE IN child abuse. It’s so very 1984. Hope this case results in a very quick retreat from this abusive initiative on his part.

How should this proceed? I understand that’s the reason for the lawsuit filing, but in your opinion can the state - any state - require a parent to provide them medical records for their child?

Not having experience with anything like this, I assumed the state would need to get a court order for the records, which if something is clearly amiss, wouldn’t be a problem obtaining.

It just seems bizarre that they would go directly to the parents and demand medical records. I’d be inclined to say no simply on principle, as would most parents.

Not without a search warrant supported by probable cause that it will lead to evidence of a crime. And the parents did say no when the investigators requested a waiver.

How long will this take to escalate up to an SB 4 situation where citizens can turn in parents that take their child out of state for gender-affirming care?

So Abbott wants to make it sorta illegal to be transgender eh? Who taught him about Birds n Bees as a kid? He sure as hell does not understand biology or that gender isn’t binary as in one is or is not a certain gender. Hormones in utero and genetics determine gender and it is a continuum. It’s not choice and it’s not illegal to be “in between” in anatomy. This is a politician trying to practice medicine without a license.

Texas has no criminal jurisdiction over things that happen entirely outside its borders, and the right to travel is constitutionally guaranteed.

Perhaps these children should testify in hearings of this type and start with “my body my choice” and ask if anyone objects to that concept.

From what I can see Texas and Florida are in competition to see which can shit on that concept the most. Both states have crazy partisan Judges that will move this type of personal invasion and violation of medical privacy into the OK column.

Initially yes. But if he pulls it off what’s next? Breast augmentation is a treatment for body dysphoria. Altering your physical type. Skin bleaching? Nose jobs? Logical extension says Abbott goes there if this outrage today sticks.

No. Nor does that matter. If I chose to know I’d look it up. ANYONE can understand that. But if you’re suggesting that Texas is a bastion of Judicial liberalism I’d say you best look up few things yourself. My point was aimed at the Judicial inclinations and tenor in all of Texas and Florida. You’re an attorney…what do you think about that Abortion law that’s still on the books in Texas because SCOTUS didn’t do shit about it either? What proper and charitable Court in Texas is going to knock that outrage down? Seems none or they damn sure are in no hurry.

My man, Travis County and the Austin Court of Appeals are 100% Democrats, and mostly of the pretty progressive variety. Ain’t none of them gonna put up with this bullshit. The Texas Supreme Court might eventually side with Abbott on this bullshit, but that’s far from a certainty. And I think SB8 is plainly and obviously unconstitutional because vigilante is not a thing and definitely not a thing SCOTX is ever going to approve. So basically, I think abortion rights groups should have ginned up a real test case in a friendly county and dared SCOTX to give its blessing to vigilante standing when they know good and well this state is getting real close to flipping and it could so easily be weaponized against their oligarchical and cultural interests.

I agree wholeheartedly. I lived in Austin for a bit and found it like San Fransisco. But there’s a lot more to Texas than Austin, San Antonio and Dallas. Statewide they elect wing nuts like Abbott and he in turn stuffs the states Courts with reactionaries. We’ll see. The argument you make was made for that abortion law and voter suppression laws. They’re still there and from what I’ve read today…mail in ballots are being punked ll over the state. You’d have to be a bit myopic not to see this anti Trans crap as nothing but an extension of the abortion crap and done because they got away with the initial crap.

I don’t think Texas is going to make ANY major progressive moves until the progressives in that state move the ole boys out. This blatant bigotry will survive because folks want it to. The majority…no way. But the folks in a position to yea or nay it are all yea for now.

Yes, but this lawsuit is in Travis County. So it doesn’t really matter that other places inside the state are so retrograde. And this case will establish important precedent (not to mention that any investigations initiated elsewhere by DFPS can also be shut down by filing suit in Travis County).
