The White House plans to formally tell House Speaker Nancy Pelosi (D-CA) as early as Friday that it will not cooperate with the House’s impeachment probe, the Associated Press reported.

It was apparent at the time Pelosi’s initial impeachment inquiry gambit would be exposed for the toothless gesture it was. Have Jim Clyburn do his job and count votes. If you have a House majority hold the vote. Lay your cards down and show your hand.

The White House Counsel’s Office is preparing a letter to send Pelosi arguing that because the impeachment inquiry was not opened with a full House vote, Democrats are merely conducting congressional oversight

and they are right in this case. The Constitution provides impeachment powers to the House as a whole. So while anyone can say ‘its an impeachment investigation’, until the House acts^^, its not “impeachment” under the constitution.

^^Pelosi actually was delegated the power to make it impeachment officially in Resolution 430, but she has chosen not to use it by invoking impeachment powers specifically in a court case.
