We Have Now Arrived At The Logical Endpoint Of Trump’s Immunity Argument | Talking Points Memo

NEW YORK — I wasn’t expecting laughter in court today.

But at the Second Circuit Court of Appeals in Manhattan, there were stifled chortles as personal attorneys for President Trump finally arrived at the logical destination of their argument that he is immune not only from prosecution – but from investigation.

So… Trump is King and rules by Divine Right?

Wow.

Wait until he invokes prima nocta.

Consovoy argued that the Constitution prevents a sitting president* from being indicted?

I think he’s confusing the Constitution with the OLC opinion. That does not augur well from his success before this panel.

Once again, Trump fails to “hire the best.”

When you take an absolute position in Court, you are very likely to lose. Unless, as may be the case here, you know that the Supreme Court is fixed in your favor.

Professionally speaking, I don’t believe that to be the result. More likely the case (and all others arising from the search for information for impeachment and otherwise) will be argued late in the term and decided on the last day of the term, June 30. And the information will be turned over in late July. So, the proceedings will have to compete with (a) the Democratic convention, (b) the summer Olympics, © the Republican convention, and (d) the election campaign.

This will give the word “circus” a whole new meaning!

I had to resort to Google to figure out that a “somewhat bilious affect” means that he seemed peevish and annoyed.

Does this argument apply to all presidents or just the legitimate ones?

Well, sort of.

The OLC opinion purports to be based on the Constitution, as you’d expect.

So the President could massacre the members of Congress and the Judiciary and establish a police state and suspend elections.

But he could be impeached. It’s the hidden zombie clause in the Constitution. If the Prez massacres Congress they are constitutionally allowed to rise from their graves as zombies and impeach the President.

“this case seems bound for the Supreme Court.” Well you can call it a Court I guess but GOP clearing house would be a better term. If it goes there the Boyz in the Robes will let Trump waltz. He gets a 5/4 get out of jail free card. You know that. I know that and so do those lawyers.

There are at least four Justices in the SC that agree with that.

I wasn’t expecting laughter in court today.

But if anyone deserved the comic relief, it’s Mr. Kovensky.

@josh_kovensky

Consovoy […] told the appeals court that previous probes had been “handled with sensitivity” appropriate to the office.

And that’s the problem: there has been far too much deference to the Executive Branch, never mind one that is controlled by crooks.

I have your crown right here for you, Donald.

Didn’t we fight a war against the last guy who claimed to rule over us by Divine Right?

With all these unlimited powers in store, I can’t wait until we inaugurate Queen Warren in Jan 2021.

“this case seems bound for the Supreme Court.”
And that will be the litmus test to see if we are still a nation of laws, or if we have descended into autocracy.
