Either Kavanaugh was sipping his beer (because he likes beer) and not paying attention to what his clerks were giving him, OR he just let his clerks do all the work and never reviewed it and just hit send.
Oh wait, why would he even read or review what his clerks wrote. It’s not his job.

I would lay even money that it now will be some time before we have another signed opinion from K. He will need to lick his wounds, and stew in his resentment of being publicly humiliated by…well, by pretty much every american with a 4th grade education and the ability to string a few thoughts together.

This is but one example of how Kavanaugh’s opinion was an embarrassment. Fundamentally factual incorrect and basically nonsensical, as pointed out by Tierney Sneed’s reporting on TPM yesterday. Rantings from the fever swamp, wholly unbecoming of a Supreme Court opinion. Really just pathetic that we’ve sunk this low.

It really could go either way. I doubt he normally writes his own opinions. You can probably count on one hand the number of judges (or justices) who do.
But he has to have top-flight clerks being a Supreme, right? So either he really did just write this one himself without putting the work in, or some clerk really fell down on the job.

Also in his opinion, Kavanaugh ranted against counting votes that arrive after election day, stating that “states want to be able to definitely announce the results of the election on election night, or as soon as possible thereafter”. As TPM pointed out, States never definitively announce election result on election night. Those calls, which are often just projections made by the media, are always based on unofficial tallies that don’t include the counting of provisional and overseas ballots that will last several days after an election.
So the concept of having results on election night is entirely a media construct, and has nothing to do with how elections actually operate. And here we have a Supreme Court justice proclaiming falsely in an official Supreme Court opinion that states want to announce final results on election night. So how about another State election official stepping forward like the guy in Vermont to request another correction on this point? Let’s keep tearing down that opinion.
