Thank you for a moment of rationality in this days gloom and doom story. The people turning out in droves to overturn GOP held posts in Texas in spite of/because of the gerrymandering is the backlash I hope to see around the nation. Capitalizing on the outrage is what will overcome these attempts by right wing justices to subvert our democracy. Get out the vote people.

Well, Dems control both houses of the state lege, plus the governorship, so here’s one…
How about this weekend, they expand the state supreme court by two judges, the guv nominates them, the state senate approves them, they’re sworn in, the AG brings the case back before the newly-expanded court, they rule overnight, and the will of the people is upheld in a reverse decision by Monday morning?
Voilà!
After all, why should Dems play by a different set of rules than the GOP? They have the power (and the legal authority) so why not use it? Republicans sure AF would–and have, even as we speak!
“Legal pathways” exist for Dems no longer willing to play with one hand tied behind their back; they just have to use them.

Oh please. Trump did not follow the rules on Jan 6th and he was not able to stop the certification by simply ignoring it. It is kind of like Luigi and the Health Insurance industry. He had enough and the result is they are still in business, and he is trying to avoid the death penalty. If the court says they can’t redraw the map, they can’t just stick their fingers in their ears and pretend not to hear them and magically make it happen.

Can they just bring it back once it has been ruled on? I have seen some versions of that in the Supreme Court, but it took years, not days.

I am not sure that is true. California and Virginia used referendums to give the people a chance to have a say in the outcome. If I am understanding this correctly it is the referendum that was the problem. If they control the legislature, maybe Democrats could just go at it that way.

It makes me wonder why anyone ever thought the conservative majority on the Virginia supreme court would ever approve of this. For months it was just assumed that Virginia moving forward with redistricting was a done deal, the most successful example yet of elected democrats fighting back. This is just tragic and demoralizing.
