Counterpoint: Nearly every country has pre-existing laws in place to pardon or commute the sentences of all kinds of criminals. War criminals are not exempted from the pardon power under the laws of any nation, nor do the Geneva Conventions prohibit their member states from pardoning persons convicted of war crimes. Trump’s pardons of all these war criminals are a goddamned disgrace, but they are not violations of any law.
Rumsfield supposedly left Paris in a big hurry after he was no longer SOD because of concerns about being charged with war crimes. I wonder if any of the principals in the Bush Jr administration have traveled to Europe since the end of his administration. I would like to see Stephen Miller, among others, get put up on charges of crimes against humanity.
There was a day when the US justice system was the blue chip standard and frequently used as precedent on international cases.
That is no longer true today. The US justice system has lost its way. Today, we see systems such as Canada being used in International cases.
I sure hope one day we as a nation can find our way to a better place with a more fair justice system, economic system, and social system. We have a lot work to do on reforming our “system” and “systems” if we want to restore our Democracy. If not, then I am in the wrong country for what I want in a society. It’s hard to vote for any Republicans and even challenging for many Democrats…they don’t seem to see the systemic problems that I see.

POTUS Biden should consider extradition of these Blackwater bastards to Iraq to face trial there. There is nothing in Trump’s Pardon that would prevent a POTUS to honor an extradition request from Iraq, since the crimes Trump Pardoned are US Federal crimes only and do not impact defendants liability under Iraqi or International Law.
If only America belonged to the ICC. Because of its concern that it might one day have to surrender a citizen, particularly a member of its government or armed forces your governments, both partys, have never joined. Rump even condemned it. I wonder why.

Can Iraq seek extradition since they are no longer being punished in the US? And can we hand them over? The pardon doesn’t save them from an extradition request.

The US Constitution would supersede that. Plus they were charged with murder, so they were in fact held accountable. It does not specify the extent of the accountability.
However, if an international court, or an Iraqi court, wanted to try them, I am wondering if we could just turn them over to them. I’m no expert on that, but it’s something I’d like to see explored.

I’m steeling myself for when Biden’s AG pick says challenging the legality of umpteen illegitimate pardons won’t be challenged “in the interest of political stability,” essentially a repeat of the “look forward, not back” approach taken by Obama (which, BTW, made me lose my respect for both Obama and Eric “Place” Holder), more (and even more egregious) crimes will continue to be committed with impunity.
