They were arguing that without such a caveat he would essentially be completely above the law, a monarch. Of course, they also never speculated on whether SCOTUS would reach the same conclusion. And who can blame them?

There is a solid legal argument that the pardon power does not include the power to pardon yourself. That argument has never been tested, of course, but basically it invokes the common law principle that no man is above the law and injects that into the scope of the pardon power. I don’t find it terribly persuasive myself, but I would not mind seeing it tested on Drumpf if he tries a self-pardon on the way out the door.
I too would like to see it tested, if for no other reason to see if all the lip service about “no man is above the law” is actually true.
Thankfully, he’ll still be subject to state law. Moreover, his (and his family’s) chances of being pardoned by any governor of any state that goes after him hover right around zero to none.
