No executive privilege that I can imagine for this call. He is not seeking advice, he is dictating that crimes be committed on his behalf, and threatening an election official with jail if he doesn’t bow down.

Executive privilege is not a “Writ in Stone” bedrock concept anyway. Its a very gray legal concept that the Courts haven’t fully defined themselves. It basically applies to battles with Congressional oversight, and is usually ruled something along the lines of “yes, the President has such a privilege, and yes Congress have the power of oversight. So play nice with each other and figure out a compromise”

There is no way the Courts are going to accept an assertion that every conversation the President has, including conversations conspiring to commit crimes, are subject to executive privilege. And that would be the theory they would have to trot out. And certainly not as part of a criminal trial to throw out evidence, which is what is on the table tonight.

I’ve heard part of the phone call tape of the trump Raffensperger call now and if this isn’t illegal election fraud by trump trying to create nonexistent votes I fail to know what is. He actually demands that Raffensperger find votes so that trump can say he won. He knows he didn’t win. He is demanding people in Georgia violate the law. It’s amazing that he thinks he can get away with this shit.

But Raffsy did “suggest” at three separate times that he would agree to have lawyers from his side explain shit to lawyers from their side in an obvious attempt to draw the conversation towards a close. Trump just wanted him to say that he won the election instead, so he kept pleading like a boy who can’t get a cheerleader to go to the prom with him. And on and on and on it went…

No, his defense here will be to bluster through it and dare anyone to indict him. And sadly, I think his odds are pretty good on that.

Oh, and this call probably involves committing numerous state felonies as well as the Federal ones. So pardons aren’t going to work.

Don’t be too sure - I read some of the comments on the Fox News link on the story they have up on this topic. The comments were very interesting because they weren’t in favor or making excuses for Trump - more than a few said he needed to resign. It was surprising.
