This is how the Department of Justice described the efforts by its legal foes to connect the Trump administration’s push to add a citizenship question to the 2020 census to the partisan motives of a deceased GOP operative.
Doesn’t matter what Trump says. He’s so manifestly effing stupid the courts, the DOJ and those in his administration can get away with saying no one should be paying attention to what he says or thinks.
Can’t wait until Judge Hazel hears the DOJ argue the diametrically opposed position with a straight face. No wonder the lawyers are changed - but that doesn’t mean a thing. The position the first set argued so vehemently was made on behalf of the same client. You don’t get a do over with a new lawyer.
This story is a re-hash. It was reported last week that Trump said that the citizenship question was useful (or necessary in his view) for re-districting. That story was news precisely because it had been reported widely that the maladministration’s arguments for allowing the question denied that affecting district lines was the reason for it. So, what does this story add, apart from a misleading headline? Nothing.
there is an obvious reason why “redistricting” would not be used as the reason – every sane lawyer knows that it would never pass muster even with the Roberts court.
This case is now all about discovery – and that is the reason why the DoJ switched lawyers. The switch makes it possible for the DoJ to ask for a delay in the discovery process while its new lawyers get up to speed on the case. @bobatkinson
I don’t think the judge is going to allow the DoJ to get away with that – and I suspect that Barr himself will be called before the court to explain why the team has been changed.
Okay a couple of things here. One maybe OT is that Josh’s interpretation of the WaPo/ABC poll ignores the fact that even though Sanders seems to be in second place behind Biden the largest number in the poll seems to be that by a significant margin people do not want anyone who identifies as a “socialist democrat”. How does that square with Bernie being in second place? Next up is neither Josh nor Tierney bring up yesterday’s news that the DOJ has replaced it’s entire coterie of lawyers arguing the census question. Is that not significant? Seems to me that either the lawyers are bailing because they are compromised by perjuring themselves before the court(June 30 deadline) or that these career lawyers have had a gut full and want to be removed. Is that not significant?
Didn’t we used to have a rule that said something like, “If you admit to a crime in public, we’ll take your word for it that you’re a career criminal and lock you away from normal people?”
You have to repeat this over and over in order to penetrate the “flood the zone” bullshit storm that comes out of Hair Furor’s White House… otherwise, the lies that the administration keeps repeating become the alternative facts.
