Trump Judge Wants To Severely Limit Congress’ Ability To Probe POTUS Misconduct | Talking Points Memo

If a Trump-appointed appellate judge could have her way, Congress could only investigate presidential misconduct if it formally opened an impeachment inquiry — and went through an extensive process that included a full House vote.

I thought Republicans hate people who (attempt to) legislate from the bench…

Tell me again why Democrats shouldn’t be doing all they can to expand the number of blue states.

So she attempted to define for the House what constitutes an impeachment. Isn’t that an assault on checks and balances and therefore unconstitutional?

“Contacts of Mr. Giuliani may well have believed that their personal financial ambitions were stymied by our anti-corruption policy in Ukraine,” she said.

And that’s one of the many reasons why it’s important we expand the courts.

Hasn’t anyone told her that she doesn’t get to set House Rules?

I am so grateful that we were protected from the evils of the Clinton Foundation and Hillary’s emails.

“She also suggested that the courts have the ability to decide what constitutes an impeachable offense.”

The Constitution, itself, dissents from this crazy woman’s opinion from the bench:

“The House of Representatives … shall have the sole Power of Impeachment.” – United States Constitution (Article I, Section 2, Clause 5).

Her refusal to accept those simple words renders her totally unfit to sit on the federal bench.

At this point, the House could begin well-justified impeachment proceedings against her.

“She also suggested that the courts have the ability to decide what constitutes an impeachable offense.”

Didn’t I hear an Activist Judge meme in the Republican world? Something about let Congress do what it is supposed to do, preserve the Constitution, follow the will of the founders? Must be my ears.

[I see Irasdad got there first.]

Rao is not legislating from the bench, she is maintaining the practice of the late, great Justice Scalia to properly discern the original intent of the Fabled Founding Fathers. It is abundantly clear to any student of history that when the Constitution expressly states that “The House of Representatives . . . shall have the sole power of impeachment” and “Each House may determine the rules of its proceedings” it meant with the prior approval and concurrence of the Judicial Branch.

Not sure that blatant political partisanship masquerading as judicial interpretation is an impeachable high crime or misdemeanor.

A lifetime appointment. Times however many McConnell has pushed through. This is going to haunt the US for decades.

All of them. Barr, Pompeo, Kavanaugh, Ross, Rao, Pence, Putin (in absentia), Barr (because he’s done enough to warrant two impeachments), Mnuchin, Mulvaney (even if C0S is not an impeachable position).

Every fucking one of them.
