There is no point of law for EP. It’s this ephemeral concept that never gets case law because it either ends in negotiations or the clock running out, so not much to go off of.

Executive privilege does not, or at least should not, be available to completely block a witness. It can only be asserted to block a reply to a specific question, and it cannot be used to hide criminal behavior. That puts all the weight on Roberts.

If it does it shouldn’t, makes absolutely no sense as it would be antithetical to the very concept of impeachment powers. But if it does exist in some form, I’d wager it would only have to do with protection of state secrets that are extraneous to the impeachment and inextricably related to national security. I don’t believe for a minute it could be meant to obstruct germane testimony.

Remember, McConnell has already admitted working hand in glove with Trump in preparing for the Senate trial. Is there any doubt that McConnell is completely on board with this executive privilege nonsense? He probably suggested it. Let me remind you that you don’t have to live in Kentucky to vote against Mitch McConnell.

Someone should explain to Trump that executive privilege does not protect statements made as part of a criminal conspiracy or which, in themselves, form the corpus of a crime (i.e., statements made to solicit a bribe or to obstruct justice). Mind you, I don’t think it will register with him, but it will allow us to tell who (if anyone) in the White House understands the law and the Constitution—because Trump will fire anyone trying to give him that advice.
