Originally published at: Trump Gets Significant Early Win in Mail-In Ballot Case from Supreme Court - TPM – Talking Points Memo
The Supreme Court on Monday lifted an injunction on an executive order that would create citizenship lists to control who can vote and give the federal government control over who receives a ballot. But another injunction keeps the order blocked, for now. The three liberal justices dissented. This is a breaking news story and will…
I am so effing done with this bullshit.
What the actual fuck?
Like, seriously, how can they chop up the proverbial baby like this. Election is less than 90 days from now.
Time will tell?
Is this some new fascist trolling?
“executive order that would create citizenship lists to control who can vote and give the federal government control over who receives a ballot. But another injunction keeps the order blocked, for now…”
But first the SCOTUS majority would like to discuss security details for themselves
Questions: given the trajectory of this ruling, will the Post Office mail my ballot to me? Will the Post Office deliver my ballot once I’ve completed it and placed it in the mail box? How many law suits will take how many years to resolve issues of recieving, sending, and counting ballots in 50 States?
“Article III prohibits federal courts from stacking hypothetical on hypothetical to speculate that harm will eventually materialize*,” they wrote.
Of course not. You can’t stack inferences anyway. That’s not good logic.
They also claimed that the states “lack a ‘well-founded fear’ that they will be prosecuted for not using the Lists.”
Recently states are routinely penalized by the federal government if they disagree with this president. Of course they will suffer damage if the Lists are used. It changes the law. It was the state’s domain and now the feds have taken it away without good reason. Where are all the constitutional literalists?
It is a power grab.
And as soon as tomorrow, the lower court judge hearing the case may also issue a TRO against the new rule the USPS issued Friday night to implement the executive order.
In other words, this is a small win for the Trump regime, but *not* a ruling that fully clears the way for Trump to mess with mail-in ballots come November.
It doesn’t change the fact the MAGA 6 on SCOTUS need to lose their majority and the court membership expanded.
“Justice Ketanji Brown Jackson went much further,”
Evergreen phrase, God bless her.
Thank you KBJ for fighting the good fight.
I don’t see how this can possibly go into effect before the midterms, so I’m going to assume (yeah, I know) we shouldn’t panic and just see how this plays out.
If it cleared a final SCOTUS hurdle, then for a state like my former residence in WA it basically means no you can’t vote by mail because the necessary systems don’t exist. In a state that votes almost exclusively by mail.
It’s now very clear that IT IS NOT SAFE to vote by mail in this election. Dump and the Extreme Court Six will very likely throw your ballot in the trash if you do.
We will expand the court. We will arrest the corrupt jurists. We will restore democracy.
This week, its too soon to sue to STOP the rule from being implemented.
And next week, it will be too LATE to make changes to rules already in place.
Here in Arizona I am occasionally reminded that we live in a republic, not a democracy. Not quite accurate; we live in a constitutional republic in which the people govern through elected representatives, all constrained by Constitutional rule of law. Whether that constraint is valid seems to be the issue currently. The executive violates it at will. The Supreme Court appears to be mostly ok with the unconstrained executive. Congress currently tolerates an unconstrained executive in his contempt for the rule of law. And the people?
When the cult has taken over much of the voting public, the House of Representatives, the Senate, the majority of the Supreme Court, and much of the powerful business community, we are totally f_cked!
Nobody can get standing with this court. They can’t enforce Emoluments. They can’t stop Trump from selling pardons, or just using them for obvious corrupt intent - because NOBDODY can make a timely argument on standing - i.e. - that they’re directly harmed - that satisfies these cranks.
If they ever had legitimacy , they lose it every single time they use that corrupt argument to nullify people’s sincere attempt at honest government and justice.
Well, turns out the terrorist sleeper cell was the Supreme Court of the United States all along. Huh.
Grateful for @demosthenes59’s response above. And caution against panic. Important to keep breathing and, once again in this nation’s history, to decide who we are.
Interesting how law applied to government – disallowing mail voting – bears no resemblance to law applied to people – millions of people voting by mail happily and responsibly. One of whom is the President.
Then again, who knows how to build a big government better than Republicans?
Yup, who would have ever thought that the SCOTUS would become members of the American Taliban? The conservative’s claim of being “strict constructionists” was, and always has been, bullshit.
