But that’s what most of us thought about the ACA case before the 5th circuit. The law, it appears, is almost never what it seems to be, but what folks think it should be.

No DOJ lawyers since if Consovoy loses, the appeal will be by the DOJ, setting up a whole new (and delayed) starting-over point. Point being, getting this all delayed time and again IS their only strategy in trying to run out the clock.

Btw, if Trumpy does lose the election and we continue to pursue this and most other lawsuits, the DOJ must drop out and the Trumpenfueher will end up paying his own personal attorneys on every single case. Oh Happy Day, I say!

Hearing seems to be going well for Team Blue. Would be nice if they had the other set of subpoenas that relate to Mueller fact witnesses going at the same time. A win here (likely) doesn’t necessarily mean a win there b/c executive privilege is not being considered here but will be on those other subpoenas + the ones that Nadler/HJC just issued.

Everything he does is based on that. My one question in this whole affair, what is he so afraid of being revealed. Burning question obviously. But it looks worse every time he stalls.

Acosta out. Thought his departure would be timed for the Mueller hearing but doing it now should make everyone realize what a terrible mistake it was to send him up there. Everyone now knows that Trump protects rapists and is himself a rapist. Each week there will be more stories about Epstein and eventually people will come back to an early smoking gun: that Trump raped a 13 year old in 1994 at an Epstein party.

In addition, this episode should make people realize that the MSM punditry is full of s**t. Many tried to argue that he did an ok job, enough to save his job, even though he lied and further exposed his malfeasance throughout.

There’s no way in hell the Democrats continue with investigation. First, there would be endless stories from Chuck Todd types about it being “retribution” - and the Democrats always fold when it comes to that sort of coverage. Second - when have they mounted any meaningful investigations after the fact? No WMD hearings. No financial crisis hearings.

When confronted by legitimate, pertinent legislation,

9:58 : Judge Millett presses Consovoy, saying that under his “naive” theory, the court would have to accept that various pending pieces of legislation in the House are “a ruse.”

Consovoy replies: “We think that underlying legislation would be unconstitutional.”
