Former President Trump asked the Supreme Court on Tuesday to throw out an 11th Circuit Court of Appeals ruling that allowed the DOJ to continue accessing classified records it seized from Mar-a-Lago.

But as you noted earlier, they still like to pretend. Otherwise why bother with lengthy opinions justifying terrible decisions?

But they have things they want to do and helping Trump might not be high on that list.

I’ll defer until the legal beagles weigh in, but on a once-over read there’s really not much there there to rule on. Whatever damage was done by letting the government have the stuff is already done, Supreme Court loves a moot case that they can just ignore. Sending the classified documents back to the Special Master in the request doesn’t seem to actually accomplish anything.

It’s like, what, your spouse finds a whole sexting thing with chats and pics with another person, reads through everything, then you go to the Supremes to take your phone back and what, your spouse has to unsee everything and just go back to the way it was?

I fully expect them to bail him out at some point in all of this. But it’ll be something like when he’s facing charges or actually convicted. This filing just seems like too much of a nothingberder to get their hands dirty for.

I just read the first part of the filing, and of course he insists on being called “President Trump” throughout, with language like the following bit. Someone really needs to tell him he’s no longer the President:

Moreover, any limit on the comprehensive and transparent review of materials seized in the extraordinary raid of a President’s home erodes public confidence in our system of justice.

Agreed 100% but I’ll take whatever joy I can these days. At least when I am breathing coal dust, I’ll know that Trump is also miserable because “his” court didn’t deliver for him.

I wonder what Leo whispered in his ear about this when it came time to nominate those justices. We all know Trump doesn’t know a potential Supreme Court nominee from a hole in the ground. I wish the media would stop calling them Trump judges.
