The game here is not to employ sound legal strategy or argument. It is:

  1. Make as much noise as possible to continue to beat the drum that Trumpers are a persecuted group of victims of the evil democrats, provide content for their media channels.
  2. With all of that noise, raise money from the rubes before they come for “you!”,
    and MOST OF ALL…
  3. Run out the clock, delay, delay, obstruct, delay, and appeal, keep filing lawsuits, appeals, and everything and anything, until you can get allies in place to make it go away.

Arguing Trump has any sound legal strategy is wasting everyone’s time. There is a strategy, sound legal basis is not the point.
Grownups need to start calling it what it is and stop playing along with this game.

Hard to know when a court would sanction attorneys for bringing a suit, but going strictly by what I read in this story (not the document itself), I would probably seek sanctions if I were the named defendant.

With the help of some strong black coffee and one of those frozen proof-and-bake chocolate croissant things from TJ’s, I have diligently plowed on, and sure enough, the “statement of facts” is 18 solid pages of what a big meanie Letitia James is.

Then we get to Count 1, and it’s a doozy. The AG of New York has apparently violated the 14th Amendment. You know, the “nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws” one.

Because … well, didn’t I already say what a meanie she is?

Count 2 trundles in the 1st Amendment on a gurney. Because Letitia James is a partisan uppity DemonRAT and DJT is a good God-fearing law-abiding Republican, and the only reason she’s being so mean to him is to punish him for expressing his Republicanness. (Republicanity? Rebuplicanish?)

You already knew that Count 3 would be the 4th Amendment, right? Because reasons.

Count 4: Abuse of Process. Same song, next verse. A little bit louder and a little bit worse.

The requested relief – other than the relief of getting to the end of this rambling repetitive exercise in wanton waste of electrons – is “please your Honor, make her stop being so mean to my client”.

I am now going to pour myself another cup of coffee. Only this time, mit Schuss.

Unlikely. To be sanctioned by a court a filing really needs to be egregious and commonly the lawyer would need to make a series of egregious filings before the court would actually take any action (see Sidney Powell’s outcome from being sued by Detroit). In this case the filing actually alleges legitimate causes of action, with a typical Trump/GQP-persecution complex spin. The arguments aren’t there to win a case, they’re trying to run out the clock. If Trump can get reelected President he can use that as an excuse to avoid this matter for a few more years.

No. It’s really damn hard to get disbarred. Rudy is likely to lose his license in NY, and Sidney just might lose hers in Texas. But if just filing a dumb loser of a lawsuit were sufficient cause to get disbarred or otherwise sanctioned, there wouldn’t hardly be a lawyer left to do the job.

In other news, congratulations to Alina Habba for apparently figuring out a way to get Trump to actually pay her. I assume that the guy with his office above the Lebanese restaurant was just doing the National Archives case for free, as a way to ingratiate himself into Trumpgriftopia. But this is Alina’s third or fourth appearance for Trump, and that’s a level of commitment that I wouldn’t expect to go uncompensated. Trump’s probably happy with her because she got Summer Zervos to go away.

Dear federal court, please weigh in on these questions of state criminal law. S-M-R-T. All criminal defendants should try going to federal court arguing their fraud was core 1st Amendment speech.

The allegation that Trump would fudge the book value of his properties has been something of a white whale for investigators since Cohen first publicly made that claim.

This characterization implies that the allegation (that Trump would fudge the book value of his properties) is fanciful and possibly unattainable. How did Trump manage not to pay income taxes for entire years? How did he manage to borrow hundreds of millions of dollars from banks and Russian sources after his Casinos all tanked? The only reason this has not been conclusively proven already is because Trump refused to ever disclose his income tax returns and has stonewalled congressional and NY prosecutors’ subpoenas.

Trump described the probe in the suit as a “thinly-veiled effort to publicly malign Trump and his associates."

When you’re engaged in criminal activity, investigations into that activity do, I suppose, somewhat malign you.

The solution: Stop the investigations!

Or: Don’t be a fucking criminal in the first place!
