President Donald Trump announced a pardon of his former National Security Michael Flynn Wednesday. Flynn pleaded guilty to lying to the FBI about his Russian contacts, and Trump himself fired him from the White House, ostensibly for misleading administration officials about the communications as well.
Just stumbled across something a bit OT but I think interesting – to you possibly as well. Military/overseas vote in Maine came in something like 80% Biden.
Always said if Flynn was gonna be pardoned it would be after the election.
Now, before someone parrots the line about a pardon removing fifth amendment protection against self-incrimination, I will point out that:
Flynn may still have state criminal liability, and he can legitimately invoke the 5th amendment for that.
Whatever crime(s) he gets pardoned for, there may be other crimes for which he was not indicted; after all, he took a plea bargain. So he can invoke the 5th for those other crimes, if any.
If compelled to testify under oath, he can invoke the 5th to avoid a perjury trap (helps if he does so due to advice of counsel).
For any who think otherwise, please explain why none of the six persons pardoned in december 1992 for their Iran-Contra crimes were compelled to testify, even though there was an active special counsel investigating Iran-Contra?
