Trump Allies Already Suggesting Georgia GOP Change State Law To Pardon Trump

In the wake of the Fulton County grand jury indictment of Donald Trump and 18 of his allies, Republicans and MAGA fiends are pulling out the usual stops to decry the ever-mounting list of charges against the former president. Some are calling for “civil war”; others are claiming that they fear it may now somehow be illegal to watch TV.

The pardon power is in the state constitution:

Paragraph II. Powers and authority. (a) Except as otherwise provided in this Paragraph, the State Board of Pardons and Paroles shall be vested with the power of executive clemency, including the powers to grant reprieves, pardons, and paroles; to commute penalties; to remove disabilities imposed by law; and to remit any part of a sentence for any offense against the state after conviction.

Amendments require a supermajority (two thirds) vote of the legislature plus a public vote in an even-numbered general election (so no possibility to call a sneaky special election, looking at you Ohio).

If GA Republicans want to put this on the Nov 2024 ballot, I say more power to them. GA voters can vote this down at the same time they give the state to Biden a second time.

As I recall, what he is suggesting here is called a “Bill of Attainder.” Our U.S. Constitution prohibits bills of attainder through Article I, Section 9, Clause 3, along with ex post facto laws and laws impairing contracts. Bills of attainder are banned because they violate the Constitution’s separation of powers .

Instead of an act of a legislature declaring a person, or a group of people, guilty of some crime, and punishing them, often without a trial… they are seeking an act of a legislature declaring a person, or a group of people, not-guilty of some crime without a trial.
