The news story isn’t that Trump ordered his administration to go find election fraud. The news story is that they came up empty. So he knew it was all bullshit. That makes the campaign of election fraud lawsuits and, ultimately, the Pence Gambit a conspiracy to defraud the United States, a felony punishable by up to 5 years in prison.

On the day of the election there was a data analyst with the Trump campaign telling them “Hey dude you lost”. Instead they created this chimera of the big lie which led to 1/6.

CONFRAUDUS isn’t a slam dunk, because Trump is so remarkably stupid that he may have continued to believe election fraud really was a thing. I can see a juror getting hung up on reasonable doubt over it. But I think it’s a damn good add-along charge with conspiracy to obstruct an official proceeding, the 20-year felony that he’s facing for agreeing to unleash the J6 mob against the electoral vote count.

The question for CONFRAUDUS is whether you can convince a jury of 12 D.C. citizens that fact meant, beyond a reasonable doubt, that Trump recognized The Big Lie was A Big Lie. I think it can be done, but it’s not a slam dunk.

Here’s how my closing argument would go, given that the defense would inevitably point to all the sycophantic cretins and media around Trump telling him “Sure, Boss, there’s all kinds of fraud. You wuz robbed!”

  1. Trump was whining about voter fraud for months and months before a single vote was cast, claiming that he could only lose if the election was stolen. That meant he was always going to claim fraud if he lost. Believe him, ladies and gentlemen of the jury.

  2. Here’s the litany of public servants and officials and judges and Fat Boy Billy Barr who investigated on his behalf and told him there was no election fraud. Believe them.

  3. The defense has shown you precisely zero evidence of actual election fraud, because Donnie Two Impeachments never had any evidence of election fraud.

  4. Here’s the handful of misfit toys who told their Orange Calf that there was definitely election fraud, you betcha. They’re obviously a bunch of delusional morons and deliberate liars.

  5. But I don’t even care if you think they were giving Trump their honest assessment of the election (which they weren’t, and he knew it). Because Trump wasn’t going around making claims of “On the one hand, on the other hand.” No, he was telling the entire country, the entire world, that the election had definitely, absolutely, 100% unequivocally been stolen from him. And that was a big fucking lie for which he had zero factual basis.
