The Roberts Court is happy to aggregate legislative power for itself — it will come up with a cockamamie standard of “executive adjacent” that determines which pocket recissions are permissible and then hang up a sign saying “consult us to see if a budget item meets our new cockamamie standard.” then, during the Trump administration, all recissions will be executive adjacent, but that will stop if the Democrats ever take power again.

Does anyone have even the slightest confidence the MAGA 6 on the Supreme Court will enforce the Constitution and laws?

They will do the following. A lower court will stay the Trump regime’s impoundment of Congressionally authorized money. The MAGA 6 will take the appeal. The MAGA 6 will end the stay in the shadow docket, and take years to rule on the merits. Then, just in time to bind the next president (likely a Democrat if there is a free and fair election in 2028), they’ll rule impoundments are illegal and unconstitutional.

See? It’s a way to let the Trump regime flout the law and bind a Democratic president.

a loophole… that allows them to declare congressionally approved funding rescinded if a rescissions package is sent to Congress close to the end of the fiscal year when funds will expire.

This is Republican governance. Hire a bunch of lawyers – paid for by taxes on other people – to scour every word of legislation, matched to every dictionary they can find back to the 10th Century, so they can argue that a law allows the president to do something nobody wants.
