This is probably why, at the very beginning of the indictment, it’s emphasized that lying is a perfectly fine use of “free speech.” It was basically the actions that the lies served that are being charged.
Not that magarepubs understand nuance.

This shows why Garland was right and prudent not to rush to play to the partisans and the Internet Speed comment people, and to have a Special Prosecutor.
Strong foundation in indictment, done by Special Prosecutor who knows how to handle the extremely political (Hague!), and while clearly nothing will split off or divide the MAGA True Believers, that’s not the point.
Rather it is (a) good solid law and case development and (b) on politics it’s that 5-10% floating in the key states - not national but the key states - that will make the difference between Trump II and No Trump II.
Patience, care and cold-blooded cunning. Bravo Smith, Bravo Garland.

A significant portion of that 30% received no training in civics or critical thinking due to decades-long plot by the GOP to gut our public education system. Lawrence O’Donnell pointed out last night that it was important for the Jan 6 Committee to precede Garland’s appointment of a special counsel. The excellent televised hearings prepared the ground and brought in the public. After thinking about it a bit, I agree. We have Pelosi to thank for setting up and selecting the members of that committee.
